Terms and Conditions for Classmate Playdate, Inc.

These Terms and Conditions (“Terms”) govern your access to and use of the Classmate Playdate mobile application (the “App”), which facilitates playdates for children by enabling parents and caregivers to communicate and collaborate. By accessing or using the App, you agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, please discontinue use of the App.

1. Acceptance of Terms

By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

2. Eligibility

The App is intended for use by adults, particularly parents and caregivers, and is not designed for use by children under the age of 13. By using the App, you represent and warrant that:
• You are at least 18 years old.
• You have the legal capacity to enter into a binding agreement.

3. User Accounts

To access certain features of the App, you may be required to create an account. By creating an account, you agree to:

  • Provide accurate, current, and complete information.
  • Maintain the confidentiality of your account credentials.
  • Accept responsibility for all activities that occur under your account.

Classmate Playdate, Inc. reserves the right to suspend or terminate your account for violations of these Terms.

4. Personal Information and Privacy

Our use of personal information, including data collected from chats, is governed by our Privacy Policy. By using the App, you consent to the collection, use, and processing of your data as described therein.

AI Processing: The App uses artificial intelligence (AI) to analyze chat content and user inputs for generating playdate suggestions. By using the App, you acknowledge and agree to the automated processing of this content.

5. Use of the App

You agree to use the App only for lawful purposes and in accordance with these Terms. Prohibited uses include but are not limited to:

  • Sharing false, misleading, or inappropriate information.
  • Harassing, threatening, or violating the privacy of other users.
  • Uploading or distributing content that is illegal, harmful, or offensive.

Classmate Playdate, Inc. reserves the right to monitor and review user activity for compliance and to protect user safety.

6. AI-Driven Playdate Suggestions

The App uses AI to generate activity suggestions based on user-provided chat content and preferences. While the AI aims to provide accurate and helpful recommendations, Classmate Playdate, Inc. does not guarantee the accuracy, reliability, or suitability of these suggestions. Parents and caregivers are responsible for evaluating the appropriateness of any activities.

7. Premium Services

We may offer premium services for a fee. By opting to use these services, you agree to pay the applicable fees and charges. Premium fees are non-refundable unless otherwise stated.

8. Data Security

We implement reasonable security measures to protect personal data, including encryption and anonymization. However, no system is entirely secure. By using the App, you acknowledge that your data may be accessible to unauthorized persons despite our efforts.

9. User Content and Conduct

You are solely responsible for the content you post or transmit through the App. Prohibited content includes but is not limited to:

  • Material that violates third-party rights.
  • Content containing harmful code or viruses.
  • False, misleading, or defamatory statements.

Classmate Playdate, Inc. reserves the right to remove content that violates these Terms or is otherwise inappropriate.

10. Intellectual Property

All content and materials on the App, including but not limited to text, graphics, logos, and software, are the property of Classmate Playdate, Inc. or its licensors and are protected by intellectual property laws. You may not use, reproduce, or distribute any content without prior written consent.

11. Limitation of Liability

To the fullest extent permitted by law, Classmate Playdate, Inc. is not liable for:

  • Your use or inability to use the App.
  • Unauthorized access to or use of your personal data.
  • Errors, interruptions, or delays in service.
  • AI-generated suggestions that are inaccurate, unsuitable, or inappropriate.

12. Indemnification

You agree to indemnify and hold harmless Classmate Playdate, Inc., its officers, directors, employees, and agents from any claims, damages, or liabilities (including without limitation reasonable legal and accounting fees) arising from:

  • Your use of the App.
  • Your violation of these Terms.

13. Changes to Terms

Classmate Playdate, Inc. reserves the right to modify these Terms at any time. Changes will be posted within the App, and continued use after such changes constitutes your acceptance of the new Terms.

14. GDPR and COPPA Compliance

14.1 UK and EU GDPR Compliance

For users accessing the App from the United Kingdom or the European Union:

  • Data Controller: Classmate Playdate, Inc. is the data controller responsible for your personal data under the UK GDPR and EU GDPR.
  • Legal Basis: We process your personal data based on your consent, which you provide by agreeing to these Terms and using our App.
  • Your Rights: Users in the UK and EU have rights under GDPR, including the rights to access, rectify, erase, or restrict processing of their data. You may exercise these rights by contacting us at support@classmateplaydate.com

14.2 UK Users

Children’s Code Compliance
For users in the United Kingdom, we adhere to the Age Appropriate Design Code to ensure children’s data is handled with care and transparency. This includes:

  • Providing clear and concise privacy notices for parents.
  • Limiting data collection to what is strictly necessary for facilitating playdates.
  • Ensuring that any data about children is used solely for the intended purposes of the App.
  • Allowing parents to review and delete their child’s data at any time.

 

UK Users’ Right to Lodge Complaints
If you believe we have not handled your personal data in accordance with applicable laws, you have the right to lodge a complaint with the UK Information Commissioner’s Office (ICO). Visit http://www.ico.org.uk

14.3 COPPA (Children’s Privacy):

  • We require verifiable parental consent before collecting or processing information about children under the age of 13.
  • Parents may revoke consent or request data deletion by contacting us at support@classmateplaydate.com.

14.4 Data Transfers

If we transfer your personal data outside the UK or EU, such as to the United States, we ensure it is protected in line with the UK GDPR and EU GDPR. This includes using Standard Contractual Clauses (SCCs) approved by the UK or EU authorities or relying on other appropriate safeguards.

15. Governing Law

These Terms are governed by the laws of the State of Florida, USA. However, for users residing in the United Kingdom, these Terms will be subject to the jurisdiction and laws of England and Wales to the extent required by mandatory consumer protection laws.
